هذا العقد هو عقد شراء خدمة، ويحدد الشروط والأحكام التي تحكم العلاقة بين الطرف الأول (مقدم الخدمة) والطرف الثاني (المستفيد من الخدمة) فيما يتعلق بالخدمة المحددة المتفق عليها.

This contract is a service purchase agreement, and it defines the terms and conditions that govern the relationship between the First Party (service provider) and the Second Party (service recipient) regarding the specified service agreed upon.

الطرف الأول: (وصفه) وهو المستخدم المسجل على منصة "ميثاق | Mithaq" عبر الرابط التالي: [User Profile Link للبائع]، والذي تم التحقق من هويته من خلال وثيقة إثبات هوية سارية المفعول وربط حسابه باسمه الحقيقي ورقم هاتفه وبريده الإلكتروني.

First Party: (Description) is the user registered on the "Mithaq | Mithaq" platform via the following link: [User Profile Link for Seller], whose identity has been verified through a valid identification document and linked his account to his real name, phone number, and email.

الطرف الثاني: (وصفه)، وهو المستخدم المسجل على منصة "ميثاق | Mithaq" عبر الرابط التالي: [User Profile Link للمشتري]، والذي تم التحقق من هويته من خلال وثيقة إثبات هوية سارية المفعول وربط حسابه باسمه الحقيقي ورقم هاتفه وبريده الإلكتروني.

Second Party: (Description), is the user registered on the "Mithaq | Mithaq" platform via the following link: [User Profile Link for Buyer], whose identity has been verified through a valid identification document and linked his account to his real name, phone number, and email.

يقدم الطرف الأول للطرف الثاني خدمة [وصف تفصيلي للخدمة]، وذلك وفقًا للمواصفات والجودة المتفق عليها.

The First Party provides the Second Party with the service of [Detailed description of the service], in accordance with the agreed upon specifications and quality.

يقر الطرف الثاني بأنه اطلع على وصف الخدمة ومواصفاتها وأنه موافق عليها بشكل كامل.

The Second Party acknowledges that he has reviewed the service description and specifications and agrees to them in full.

تبدأ مدة هذا العقد من تاريخ [تاريخ البداية] وتنتهي في تاريخ [تاريخ النهاية].

The duration of this contract begins on [Start Date] and ends on [End Date].

يجوز تمديد هذا العقد لمدة مماثلة باتفاق الطرفين عبر منصة ميثاق.

This contract may be extended for a similar period by agreement of both parties via the Mithaq platform.

تبلغ قيمة هذا العقد [المبلغ] [العملة] مقابل تقديم الخدمة الموضحة أعلاه.

The value of this contract is [Amount] [Currency] in exchange for providing the service described above.

يتم الدفع للطرف الأول من خلال وسائل الدفع المتاحة على منصة ميثاق وفقًا للجدول الزمني التالي: [تحديد جدول الدفعات].

Payment to the First Party will be made through the payment methods available on the Mithaq platform according to the following schedule: [Specify payment schedule].

يتحمل الطرف الثاني مسؤولية سداد قيمة العقد في المواعيد المحددة.

The Second Party is responsible for paying the contract value on the specified dates.

يلتزم الطرف الأول بتقديم الخدمة المتفق عليها بجودة عالية وفي الوقت المحدد.

The First Party is obligated to provide the agreed upon service with high quality and on time.

يلتزم الطرف الأول بالحفاظ على سرية معلومات الطرف الثاني.

The First Party is obligated to maintain the confidentiality of the Second Party's information.

يلتزم الطرف الأول بالرد على استفسارات الطرف الثاني في أقرب وقت ممكن عبر وسائل التواصل المتاحة على منصة ميثاق.

The First Party is obligated to respond to the Second Party's inquiries as soon as possible via the communication channels available on the Mithaq platform.

يلتزم الطرف الثاني بسداد قيمة العقد في المواعيد المحددة.

The Second Party is obligated to pay the contract value on the specified dates.

يلتزم الطرف الثاني بتزويد الطرف الأول بالمعلومات والبيانات اللازمة لتقديم الخدمة.

The Second Party is obligated to provide the First Party with the information and data necessary to provide the service.

يلتزم الطرف الثاني بالتواصل مع الطرف الأول بشكل احترافي عبر وسائل التواصل المتاحة على منصة ميثاق.

The Second Party is obligated to communicate with the First Party professionally via the communication channels available on the Mithaq platform.

يضمن الطرف الأول جودة الخدمة المقدمة لمدة [عدد] [الوحدة الزمنية] من تاريخ تقديم الخدمة.

The First Party guarantees the quality of the service provided for a period of [Number] [Time Unit] from the date of service provision.

في حال وجود أي خلل أو قصور في الخدمة خلال فترة الضمان، يلتزم الطرف الأول بإصلاح الخلل أو تقديم الخدمة مرة أخرى دون أي تكلفة إضافية.

In the event of any defect or deficiency in the service during the warranty period, the First Party is obligated to fix the defect or provide the service again without any additional cost.

يجوز لأي من الطرفين إنهاء هذا العقد في حال إخلال الطرف الآخر بأي من التزاماته المنصوص عليها في هذا العقد.

Either party may terminate this contract if the other party breaches any of its obligations stipulated in this contract.

يتم إشعار الطرف الآخر بالرغبة في إنهاء العقد عبر منصة ميثاق قبل [عدد] [الوحدة الزمنية] من تاريخ الإنهاء.

The other party shall be notified of the desire to terminate the contract via the Mithaq platform [Number] [Time Unit] prior to the termination date.

يجوز تعديل هذا العقد باتفاق الطرفين عبر منصة ميثاق.

This contract may be amended by agreement of both parties via the Mithaq platform.

أي تعديلات على هذا العقد تعتبر سارية المفعول من تاريخ إقرارها عبر منصة ميثاق.

Any amendments to this contract are considered valid from the date of their approval via the Mithaq platform.

جميع إجراءات العقد، بما في ذلك التوقيع، التعديل، الفسخ، التجديد، المدفوعات، والموافقة بين الأطراف، تتم إلكترونيًا حصريًا عبر منصة ميثاق | Mithaq، ولا يُعتدّ بأي إجراء أو وثيقة ورقية أو مكتوبة خارج المنصة. وتُعدّ جميع الإجراءات الإلكترونية المنفذة عبر المنصة صحيحة وملزمة للطرفين من الناحية القانونية، ولها ذات الحجية القانونية للإجراءات الورقية.

All contract procedures, including signing, modification, termination, renewal, payments, and mutual approvals between the parties, shall be conducted exclusively and electronically through the Mithaq Platform. No paper-based or offline actions or documents shall be recognized outside the platform. All electronic actions carried out through the platform are legally valid, binding on both parties, and have the same legal force as written documents.

يتفق الطرفان على أن أي نزاع أو خلاف أو مطالبة تنشأ عن هذا العقد أو تتعلق به، بما في ذلك ما يتصل بتكوينه أو تنفيذه أو تفسيره أو إنهائه، يتم حله نهائيًا عن طريق التحكيم الإلكتروني عبر منصة ميثاق | Mithaq وفقًا لـ نظام التحكيم الإلكتروني المعتمد بالمنصة. ويعتبر هذا النظام جزءًا لا يتجزأ من هذا العقد. يكون مقر التحكيم الافتراضي هو مدينة القاهرة – جمهورية مصر العربية، ويخضع التحكيم من حيث الإجراءات لقانون التحكيم المصري رقم 27 لسنة 1994، ومن حيث الموضوع للقانون المدني المصري، وتكون لغة التحكيم اللغة العربية. ويعتبر قرار المحكم الصادر عبر المنصة نهائيًا وملزمًا للطرفين، وله قوة السند التنفيذي بعد اعتماده من الجهة المختصة وفق القوانين المعمول بها.

The parties agree that any dispute, controversy, or claim arising out of or relating to this contract, including its formation, execution, interpretation, or termination, shall be finally settled through electronic arbitration via the Mithaq Platform in accordance with its approved electronic arbitration regulations. This regulation forms an integral part of this contract. The default seat of arbitration shall be Cairo, Arab Republic of Egypt. The arbitration procedure shall be governed by Egyptian Arbitration Law No. 27 of 1994, and the subject matter shall be governed by the Egyptian Civil Code. The language of arbitration shall be Arabic. The arbitrator’s decision issued via the platform shall be final and binding on both parties, with the force of an enforceable title upon approval by the competent authority.
