هذا العقد هو عقد دعم تقني يتم بموجبه تقديم خدمات الدعم التقني من الطرف الأول إلى الطرف الثاني وفقًا للشروط والأحكام المنصوص عليها في هذا العقد.

This contract is a technical support agreement under which the First Party provides technical support services to the Second Party in accordance with the terms and conditions set forth in this contract.

تعريف الأطراف الطرف الأول: (مقدم الدعم التقني) وهو المستخدم المسجل على منصة "ميثاق | Mithaq" عبر الرابط التالي: [User Profile Link للبائع]، والذي تم التحقق من هويته من خلال وثيقة إثبات هوية سارية المفعول وربط حسابه باسمه الحقيقي ورقم هاتفه وبريده الإلكتروني. الطرف الثاني: (المستفيد من الدعم التقني)، وهو المستخدم المسجل على منصة "ميثاق | Mithaq" عبر الرابط التالي: [User Profile Link للمشتري]، والذي تم التحقق من هويته من خلال وثيقة إثبات هوية سارية المفعول وربط حسابه باسمه الحقيقي ورقم هاتفه وبريده الإلكتروني.

Parties Definition First Party: (Technical Support Provider) is the user registered on the platform "Mithaq | Mithaq" via the following link: [User Profile Link للبائع], whose identity has been verified through a valid identification document and his account is linked to his real name, phone number, and email address. Second Party: (Technical Support Beneficiary) is the user registered on the platform "Mithaq | Mithaq" via the following link: [User Profile Link للمشتري], whose identity has been verified through a valid identification document and his account is linked to his real name, phone number, and email address.

يقدم الطرف الأول للطرف الثاني خدمات الدعم التقني المحددة، والتي تشمل على سبيل المثال لا الحصر: حل المشكلات التقنية، وتحديث البرامج، وتقديم الاستشارات التقنية.

The First Party shall provide the Second Party with specific technical support services, including but not limited to: troubleshooting technical problems, updating software, and providing technical consultations.

سيتم تحديد نطاق الخدمات التفصيلي وجدولتها الزمنية بالكامل عبر منصة "ميثاق | Mithaq" قبل البدء في تنفيذها.

The detailed scope of services and its schedule shall be fully defined via the platform "Mithaq | Mithaq" before commencement of implementation.

تبدأ مدة هذا العقد من تاريخ الموافقة عليه عبر منصة "ميثاق | Mithaq" وتستمر لمدة [عدد] شهرًا/سنة، قابلة للتجديد باتفاق الطرفين عبر المنصة.

The term of this Agreement shall commence from the date of its approval via the platform "Mithaq | Mithaq" and shall continue for a period of [number] months/year, renewable by agreement of both parties via the platform.

يتفق الطرفان على أن المقابل المالي لخدمات الدعم التقني هو [المبلغ] [العملة]، ويتم سداده وفقًا للآلية المحددة على منصة "ميثاق | Mithaq".

The parties agree that the financial consideration for the technical support services is [Amount] [Currency], and shall be paid in accordance with the mechanism specified on the platform "Mithaq | Mithaq".

يتحمل الطرف الثاني مسؤولية دفع أي ضرائب أو رسوم إضافية قد تنشأ عن هذا العقد، ويتم ذلك عبر الآليات المتاحة على منصة "ميثاق | Mithaq".

The Second Party shall be responsible for paying any additional taxes or fees that may arise from this contract, and this shall be done through the mechanisms available on the platform "Mithaq | Mithaq".

يلتزم الطرف الأول بتقديم خدمات الدعم التقني بجودة عالية ووفقًا للمعايير المهنية.

The First Party undertakes to provide technical support services of high quality and in accordance with professional standards.

يلتزم الطرف الأول بالاستجابة لطلبات الدعم التقني المقدمة من الطرف الثاني خلال [عدد] ساعة/ساعات عمل.

The First Party undertakes to respond to technical support requests submitted by the Second Party within [number] working hour/hours.

يلتزم الطرف الأول بالحفاظ على سرية معلومات الطرف الثاني وبياناته.

The First Party undertakes to maintain the confidentiality of the Second Party's information and data.

يلتزم الطرف الثاني بتوفير المعلومات والبيانات اللازمة للطرف الأول لتقديم خدمات الدعم التقني.

The Second Party undertakes to provide the information and data necessary for the First Party to provide technical support services.

يلتزم الطرف الثاني بالتعاون مع الطرف الأول لتسهيل تقديم خدمات الدعم التقني.

The Second Party undertakes to cooperate with the First Party to facilitate the provision of technical support services.

يلتزم الطرف الثاني بسداد المقابل المالي المتفق عليه في المواعيد المحددة عبر منصة "ميثاق | Mithaq".

The Second Party undertakes to pay the agreed financial consideration on the specified dates via the platform "Mithaq | Mithaq".

يحق لأي من الطرفين إنهاء هذا العقد في حالة إخلال الطرف الآخر بأي بند من بنوده، وذلك بعد إشعار الطرف الآخر عبر منصة "ميثاق | Mithaq" ومنحه مهلة [عدد] يومًا لتصحيح المخالفة.

Either party shall have the right to terminate this Agreement in the event that the other party violates any of its clauses, after notifying the other party via the platform "Mithaq | Mithaq" and granting him a period of [number] days to rectify the violation.

في حالة إنهاء العقد، يتم تسوية المستحقات المالية بين الطرفين عبر الآليات المتاحة على منصة "ميثاق | Mithaq".

In the event of termination of the contract, financial dues shall be settled between the parties through the mechanisms available on the platform "Mithaq | Mithaq".

لا يتحمل أي من الطرفين مسؤولية الإخلال بالتزاماته المنصوص عليها في هذا العقد إذا كان ذلك الإخلال ناتجًا عن ظروف خارجة عن إرادته (القوة القاهرة)، مثل الكوارث الطبيعية أو الحروب أو أعمال الشغب.

Neither party shall be liable for breaching its obligations under this Agreement if such breach is due to circumstances beyond its control (Force Majeure), such as natural disasters, wars or riots.

يجب على الطرف المتضرر من القوة القاهرة إشعار الطرف الآخر بذلك عبر منصة "ميثاق | Mithaq" في أقرب وقت ممكن.

The party affected by Force Majeure shall notify the other party via the platform "Mithaq | Mithaq" as soon as possible.

جميع إجراءات العقد، بما في ذلك التوقيع، التعديل، الفسخ، التجديد، المدفوعات، والموافقة بين الأطراف، تتم إلكترونيًا حصريًا عبر منصة ميثاق | Mithaq، ولا يُعتدّ بأي إجراء أو وثيقة ورقية أو مكتوبة خارج المنصة. وتُعدّ جميع الإجراءات الإلكترونية المنفذة عبر المنصة صحيحة وملزمة للطرفين من الناحية القانونية، ولها ذات الحجية القانونية للإجراءات الورقية.

All contract procedures, including signing, modification, termination, renewal, payments, and mutual approvals between the parties, shall be conducted exclusively and electronically through the Mithaq Platform. No paper-based or offline actions or documents shall be recognized outside the platform. All electronic actions carried out through the platform are legally valid, binding on both parties, and have the same legal force as written documents.

يتفق الطرفان على أن أي نزاع أو خلاف أو مطالبة تنشأ عن هذا العقد أو تتعلق به، بما في ذلك ما يتصل بتكوينه أو تنفيذه أو تفسيره أو إنهائه، يتم حله نهائيًا عن طريق التحكيم الإلكتروني عبر منصة ميثاق | Mithaq وفقًا لـ نظام التحكيم الإلكتروني المعتمد بالمنصة. ويعتبر هذا النظام جزءًا لا يتجزأ من هذا العقد. يكون مقر التحكيم الافتراضي هو مدينة القاهرة – جمهورية مصر العربية، ويخضع التحكيم من حيث الإجراءات لقانون التحكيم المصري رقم 27 لسنة 1994، ومن حيث الموضوع للقانون المدني المصري، وتكون لغة التحكيم اللغة العربية. ويعتبر قرار المحكم الصادر عبر المنصة نهائيًا وملزمًا للطرفين، وله قوة السند التنفيذي بعد اعتماده من الجهة المختصة وفق القوانين المعمول بها.

The parties agree that any dispute, controversy, or claim arising out of or relating to this contract, including its formation, execution, interpretation, or termination, shall be finally settled through electronic arbitration via the Mithaq Platform in accordance with its approved electronic arbitration regulations. This regulation forms an integral part of this contract. The default seat of arbitration shall be Cairo, Arab Republic of Egypt. The arbitration procedure shall be governed by Egyptian Arbitration Law No. 27 of 1994, and the subject matter shall be governed by the Egyptian Civil Code. The language of arbitration shall be Arabic. The arbitrator’s decision issued via the platform shall be final and binding on both parties, with the force of an enforceable title upon approval by the competent authority.
