هذا العقد هو عقد عمل يهدف إلى تحديد شروط وأحكام توظيف الطرف الأول من قبل الطرف الثاني، وذلك وفقًا للأنظمة والقوانين المعمول بها في [الدولة].

This contract is an employment agreement that aims to define the terms and conditions of employment of the First Party by the Second Party, in accordance with the regulations and laws in force in [Country].

الطرف الأول: (الموظف) وهو المستخدم المسجل على منصة "ميثاق | Mithaq" عبر الرابط التالي: [User Profile Link للبائع]، والذي تم التحقق من هويته من خلال وثيقة إثبات هوية سارية المفعول وربط حسابه باسمه الحقيقي ورقم هاتفه وبريده الإلكتروني.

First Party: (Employee) who is a registered user on the "Mithaq | Mithaq" platform via the following link: [User Profile Link للبائع], whose identity has been verified through a valid identification document and linked their account to their real name, phone number, and email address.

الطرف الثاني: (صاحب العمل) وهو المستخدم المسجل على منصة "ميثاق | Mithaq" عبر الرابط التالي: [User Profile Link للمشتري]، والذي تم التحقق من هويته من خلال وثيقة إثبات هوية سارية المفعول وربط حسابه باسمه الحقيقي ورقم هاتفه وبريده الإلكتروني.

Second Party: (Employer) who is a registered user on the "Mithaq | Mithaq" platform via the following link: [User Profile Link للمشتري], whose identity has been verified through a valid identification document and linked their account to their real name, phone number, and email address.

مدة هذا العقد هي [مدة العقد] تبدأ من تاريخ [تاريخ السريان] وتنتهي في تاريخ [تاريخ الانتهاء]، قابلة للتجديد باتفاق الطرفين عبر المنصة.

The duration of this contract is [مدة العقد] starting from [تاريخ السريان] and ending on [تاريخ الانتهاء], renewable by agreement of both parties through the platform.

يعمل الطرف الأول لدى الطرف الثاني بوظيفة [المسمى الوظيفي]، وتتضمن مهامه الرئيسية [وصف المهام].

The First Party shall work for the Second Party as [المسمى الوظيفي], and his/her main duties include [وصف المهام].

يتقاضى الطرف الأول راتباً شهرياً قدره [قيمة الراتب] [العملة]، يتم دفعه إلكترونياً عبر منصة ميثاق في نهاية كل شهر ميلادي.

The First Party shall receive a monthly salary of [قيمة الراتب] [العملة], to be paid electronically via the Mithaq platform at the end of each calendar month.

يستحق الطرف الأول الإجازات السنوية والإجازات المرضية وفقاً لنظام العمل المعمول به في [الدولة]. يتم تقديم طلبات الإجازة والموافقة عليها عبر المنصة.

The First Party is entitled to annual and sick leave in accordance with the labor law in force in [الدولة]. Leave requests are submitted and approved via the platform.

يستحق الطرف الأول مكافأة نهاية الخدمة وفقاً لنظام العمل المعمول به في [الدولة]، وتُحسب وتُدفع إلكترونياً عبر المنصة عند انتهاء العقد.

The First Party is entitled to end-of-service benefits in accordance with the labor law in force in [الدولة], which will be calculated and paid electronically via the platform upon termination of the contract.

عدد ساعات العمل الأسبوعية للطرف الأول هي [عدد الساعات] ساعة، ويتم تحديد جدول العمل اليومي بالتنسيق بين الطرفين عبر المنصة.

The number of weekly working hours for the First Party is [عدد الساعات] hours, and the daily work schedule is determined in coordination between the two parties via the platform.

يلتزم الطرف الأول بالمحافظة على سرية معلومات الطرف الثاني وعدم إفشائها لأي طرف ثالث، ويشمل ذلك المعلومات التقنية والتجارية والمالية. هذا الالتزام يبقى سارياً حتى بعد انتهاء مدة العقد.

The First Party undertakes to maintain the confidentiality of the Second Party's information and not to disclose it to any third party, including technical, commercial and financial information. This obligation remains valid even after the termination of the contract.

يجوز لأي من الطرفين إنهاء هذا العقد مع إشعار الطرف الآخر قبل [مدة الإشعار] عبر المنصة، وذلك وفقاً لنظام العمل المعمول به في [الدولة].

Either party may terminate this contract with notice to the other party [مدة الإشعار] via the platform, in accordance with the labor law in force in [الدولة].

في حالة إنهاء العقد من قبل الطرف الثاني دون سبب مشروع، يستحق الطرف الأول التعويضات المنصوص عليها في نظام العمل المعمول به في [الدولة]. يتم احتساب التعويضات ودفعها إلكترونياً عبر المنصة.

In the event of termination of the contract by the Second Party without a legitimate reason, the First Party is entitled to the compensation stipulated in the labor law in force in [الدولة]. Compensation will be calculated and paid electronically via the platform.

يخضع هذا العقد لأنظمة وقوانين العمل المعمول بها في [الدولة].

This contract is subject to the labor regulations and laws in force in [الدولة].

جميع إجراءات العقد، بما في ذلك التوقيع، التعديل، الفسخ، التجديد، المدفوعات، والموافقة بين الأطراف، تتم إلكترونيًا حصريًا عبر منصة ميثاق | Mithaq، ولا يُعتدّ بأي إجراء أو وثيقة ورقية أو مكتوبة خارج المنصة. وتُعدّ جميع الإجراءات الإلكترونية المنفذة عبر المنصة صحيحة وملزمة للطرفين من الناحية القانونية، ولها ذات الحجية القانونية للإجراءات الورقية.

All contract procedures, including signing, modification, termination, renewal, payments, and mutual approvals between the parties, shall be conducted exclusively and electronically through the Mithaq Platform. No paper-based or offline actions or documents shall be recognized outside the platform. All electronic actions carried out through the platform are legally valid, binding on both parties, and have the same legal force as written documents.

يتفق الطرفان على أن أي نزاع أو خلاف أو مطالبة تنشأ عن هذا العقد أو تتعلق به، بما في ذلك ما يتصل بتكوينه أو تنفيذه أو تفسيره أو إنهائه، يتم حله نهائيًا عن طريق التحكيم الإلكتروني عبر منصة ميثاق | Mithaq وفقًا لـ نظام التحكيم الإلكتروني المعتمد بالمنصة. ويعتبر هذا النظام جزءًا لا يتجزأ من هذا العقد. يكون مقر التحكيم الافتراضي هو مدينة القاهرة – جمهورية مصر العربية، ويخضع التحكيم من حيث الإجراءات لقانون التحكيم المصري رقم 27 لسنة 1994، ومن حيث الموضوع للقانون المدني المصري، وتكون لغة التحكيم اللغة العربية. ويعتبر قرار المحكم الصادر عبر المنصة نهائيًا وملزمًا للطرفين، وله قوة السند التنفيذي بعد اعتماده من الجهة المختصة وفق القوانين المعمول بها.

The parties agree that any dispute, controversy, or claim arising out of or relating to this contract shall be finally settled through electronic arbitration via the Mithaq Platform under its approved arbitration regulations. The default seat of arbitration shall be Cairo, Egypt. The arbitration shall be governed by Egyptian Arbitration Law No. 27 of 1994 and the Egyptian Civil Code. The arbitration language shall be Arabic. The arbitrator’s decision is final, binding, and enforceable upon approval by the competent authority.
